I don’t remember how long ago it was that I first heard about potential racism issues at Tesla’s factory in Fremont, but I think it was about a decade ago. At the time, I figured it was a case of some bad seeds in management or even just on the factory floor and not strong enough leadership to weed it out.
However, since then … we’ve seen countless racist statements, Nazi solutes (and don’t even try to pretend they were something else), and political campaigning telling us Elon Musk himself has difficulty understanding racial inequalities at best or is just downright at worst. With that in mind, it’s easier to understand how issues of racism in a Tesla factory might have sprouted up, been ignored (or, worse, encouraged), and gotten disputed for years in the courts.
Still, even with that said, it’s crazy that we’re still seeing and writing about such court cases in 2026. Yet we are.
“A California agency’s lawsuit accusing Tesla, opens new tab of allowing rampant race discrimination at its flagship assembly plant is set to go to trial on Monday, one of a series of similar lawsuits being faced by the electric vehicle maker,” Reuters writes. “Lawyers for Tesla and the California Civil Rights Department will square off in Oakland before state Superior Court Judge Peter Borkon, who has scheduled the trial to run until October 30.”
This lawsuit does go back four years, to 2022. It includes claims of constant and widespread harassment, including common use of racial slurs and racist graffiti. While the claim wasn’t that this overt racism came from Tesla management, the point was that management didn’t do enough to stop it and basically just brushed the complaints aside. Additionally, the lawsuit alleges that Black employees got paid worse and got skipped over for promotions more.
“The claims in the Civil Rights Department’s lawsuit are broader and include allegations that the Fremont plant was racially segregated, with Black workers assigned to the lowest-paying and least desirable jobs,” Reuters predicts.
While the case is in court, don’t expect a Law & Order style trial. There’s no jury, just a judge deciding the case as he sees fit.
“Tesla’s high profile and the thousands of workers involved in the case make it among the most significant involving employment discrimination claims against a major US company to go to trial in recent years,” Reuters shares.
But there’s more! This is not the only case on the matter. “The company is also facing a lawsuit from the US Equal Employment Opportunity Commission alleging racial harassment, and dozens of lawsuits by individual workers making similar claims.” It almost sounds like this was a widespread, persistent problem at the company….
